Reservation Agreement

 
 
I/We hereby manifest my/our intention to purchase the following property (the “Property”) and request that the Property be reserved for my/our purchase:

I understand that Mary’s Garden Realty Corp. is the developer of the project and is licensed to sell (No. 11246) the same by the HLURB and that the registered owner of the parcel of land has authorized the developer to sell the same in their behalf under their Joint Venture Agreement.
 
Enclosed herewith the amount of Pesos: Thirty thousand (Php 30,000.00) as Reservation Fee. I/we agree that my/our reservation hereunder is good only for 30 days, at which time my Downpayment/Full Payment check will be due. I understand that my reservation shall be cancelled and my reservation fee forfeited should any of the following not be complied with:
 
1.       Not later than 7 calendar days from my/our payment of the Reservation Fee, or on or before _____________________________________:
a.       I/we agree to send to Mary’s Garden Realty Corp. (the “Company”) the completed Buyer’s Information Sheet and my/our choice of the payment scheme under which I/we will pursue the purchase of the Property.
b.       Should I/we decide to effect our purchase of the Property under any Installment Scheme of the Company, I/we agree to sign a Contract to Sell prepared by the Company relevant to the installment scheme I/we have chosen. 
2.       In order to carry out my/our purchase of the Property, I/we agree to pay to the Company not later than the last day of the Reservation Period, the down payment which will be due from me/us under the relevant payment scheme which we have chosen pursuant to paragraph (1)(a) hereof.
3.       Should I/we fail to comply with any of the provisions set forth herein, including my/our non-payment of the down payment and the succeeding payments thereto on the relevant date at which the same is payable in accordance with the payment scheme which I/we shall have chosen, I/we agree that the Company shall have the right to cancel my reservation by way of a registered notice to the address herein provided and the reservation fee shall be forfeited.
